According to inside, anonymous sources, there are several things that are not being reported in the media about this sophisticated gang that is attacking in Heredia and Escazu. [Oops, they didn't mention Heredia, did they?]

Yet, one of these facts could help save innocent people from being attacked. So why are they not telling? Probably because this information might tend to "compromise" certain operations. Well, I say, too damn bad!

People have a right to this information so that they can take appropriate action.

What you are not being told is that this gang is impersonating FBI and / or OIJ agents! Apparantly when old Jay said "well dressed," he must have meant "dressed like OIJ and / or FBI agents," but for political reasons doesn’t want to mention this little tidbit.

So, folks, if YOU or your upscale development in Heredia or Escazu [or elsewhere] gets a group of "agents" at the door claiming to be OIJ or FBI agents or both, DON'T LET THEM IN UNDER ANY CIRCUMSTANCES! Instead, do what you SHOULD automatically do ayway.

Make them wait outside and call the OIJ and / or your attorney right away to verify that these "agents" are for real. In fact, having your attorney come by for a visit while they are waiting outside your gate is a good strategy to get rid of these vermin, and your other call to the real OIJ should hopefully get the real cops on the way to catch these snakes.

Of course, I am sure that telling these guys they have to wait while you call the OIJ for verification will not amuse them in the least, and they will probably make all kinds of threats. Just tell them that they must wait while you verify their identity, and ask the guy at the gate [through the loudspeaker, not in person, otherwise they will put a gun in your face and tell you to open up or else] with the big mouth for his name and badge number while you are at it.

Mention that if they violate your wishes, and enter private property without proper authorization, you will exercise your rights and use armed resistance. This should make these bandits flee the scene, I would think, as they will realize that you will not roll over and play dead for them and the real cops are now on the way.

Alert all of your security personnel to this procedure that under NO CIRCUMSTANCES are they to open the gate for ANYONE they don't know, until they actually VERIFY the truth of what they are being told. They must also be alerted to sneak attacks.

Thank you everyone for your assistance in gathering news data that others don't dare to put out! KEEP THE INFORMATION COMING! We will, of course, keep your identity TOTALLY CONFIDENTIAL. If that isn't enough, we have several methods of secure communications so that you don't even have to identify yourself even to us.

Hopefully today's tip will take a bite out of crime and catch these creeps!

Finally we have for you the Summary of the Court decision, but before I go for the weekend I just wanted to give my thanks for all the nice comments, and yes I'm blushing...

Summary of the sentence of the constitutional chamber of the Supreme court of Justice regarding the action of appeal presented against the department of Pensionados and rentistas of the General Direction of Immigration and Foreigners



Antecedents: approximately since October of 2003 the department of Pensionados and Rentistas of the General Direction of Immigration and Foreigners has suspended the process of renewing the identification card to hundreds and hundreds of residents, considering that the residencies were not legally approved as the files did not include the birth certificates and police reports with the consular requirement. The lawyer Lilliana Torres of the Association of Residents of Costa Rica presented four actions of appeals for different members of the Association, in the Constitutional Chamber of the Supreme Court of Justice, maximum judicial institution. Of these four appeals presented, three have been resolved and they were declared "con lugar", in other words they were declared in favor of the members of the Association. We have the resolution of the Constitutional Chamber, which resolves one of these resources. Following is a summary of it:



The action of appeal was presented by the members of the Association, claiming the following points:



1- That the department of Pensionados and Rentistas of the Costa Rican Institute of Tourism granted the residency.

2- That the identification card is renewable every two years.

3- That the department of Pensionados and Rentistas of the Costa Rican Institute of Tourism was transferred to the General Direction of Immigration and Foreigners in August of 2002.

4- That the actual department of Pensionados and Rentistas of the General Direction of Immigration and Foreigners requests the presentation of documents which have been already presented to the Costa Rican Institute of Tourism according to the same resolution which approved and granted the residency and that this department does no authorize the renewal of the identification card until the stated documents are presented.

5- That by not authorizing the renewal of the identification card, the resident becomes undocumented.



The General Direction of Immigration and Foreigners opposed the action of appeal manifesting the following:



1- That the Costa Rican Institute of Tourism granted the condition of Rentista Resident or Pensionado.

2- That the Rentista or Pensionado must renew their identification card every two years.

3- That since August of 2002, the General Direction of Immigration and Foreigners is the institution in charge of knowing the procedures of Pensionados and Rentistas.

4- That this institution requested the resident the birth certificate and the police report, documents that have to comply with the consular requirements to rectify the procedure as they, coming from foreign countries were not duly legalized and therefore the identification card will not be renewed until these documents are legalized by the consular authority.



The constitutional chamber considered the following:



1- That the department of Pensionados of the Costa Rican Institute of Tourism granted the condition of Rentista Resident or Pensionado, indicating that the documents were duly presented.

2- That the functions of the department of Pensionados and Rentistas of the Costa Rican Institute of Tourism were transferred to the General Direction of Immigration and Foreigners in August of 2002.

3- That the department of Pensionados of the General Direction of Immigration and Foreigners communicated the resident that the request of the renewal of the identification card is suspended until the birth certificate and police report are not presented.

4- That to request again documents that the administration (government) received in accordance when the resident was granted the condition of rentista in order to renew the identification card, it is now improper (irrelevant), as it implies to un-recognize a right that was granted by a resolution of the Costa Rican Institute of Tourism.

5- That the administration cannot go back on his own acts, in other words that the administration is forbidden to suppress by his own action those acts that have been issued, which give subjective rights to individuals. The only way that the government can eliminate an act is by jurisdictional process of injury ("lesividad"), as this process is conceived a procesal guarantee in favor of the people. (Process of injury: is a trial in the court of Justice to declare the absolute nullity, evident and stated in an act of the State).

6- According to the criteria of the Constitutional chamber, if the State granted the resident the condition of Pensionado or rentista, by demanding the birth certificate and the police report with the dully consular requirement, injures the right of the resident, who as long as he complies with the requirements of the law and the regulations imposed to him, have the condition of Pensionado or rentista and the renewal of the identification card cannot be conditioned more than to the enforcement of the requirements established for that renewal.

7- In consequence, the action of appeal must be declared "con lugar" and the resolution of the department of Pensionados and rentistas of the General Direction of Immigration and Foreigners which demands the presentation of birth certificate and police report with the consular requirements has to be nullified.

8- The State is obligated to pay all costs, damages and perjury caused.

Good day to all. We have two very positive announcements to make today in regards to immigration which should make many of you rest easier.



The first is in regards to the proposed elimination of Rentista status, which has been mentioned several times in the press. We have carefully studied the proposal for immigration as it stands at this point, and it would appear that the elimination of the law 4812 is no longer mentioned in the proposal. Law 4812 is the Pensionado/Rentista law, and therefore it would seem that both of these types of residencies would continue to be extended. As for any proposed changes to the law 4812, we are currently looking for all legislation in regards to this, and (as with the idea to eliminate Rentista), the Association will lobby against any points we feel are detrimental, again asking for your continued support.



The second announcement is in regards to all those who are having problems renewing their Pensionado/Rentista status due to supposedly incorrectly authorized documentation. The Association of Residents, along with Lic. Lilliana Torres, have now won three of the four cases presented to the Sala Constitutional. According to the official Sentence received Friday, confirming what we have previously stated, Immigration may not ask for new documentation required in granting residency during the renewal process, as the residency has already been granted. The only information they may request at renewal time is that required for renewal (ie. Change of money/ proof of time spent in the country). The State has been declared to pay all costs and damages.

The Municipalidad de San José is taking on street vendors again. The councilmen for the canton voted Tuesday night to give the merchants three months to close up their sidewalk shops.

The municipality and the merchants periodically engage in confrontation. The merchants now are generally located along Calle 8 and in the area around the Central Market. This is an area specified in an agreement in 1995.

The municipality claims that passers-by say they are unable to use the sidewalks. The merchants sell fruit and vegetables but also hard goods, clothing and sometimes products of dubious precedence.

There are about 500 such small stands where many hundreds of persons find employment. Many are foreigners who are no legal, and working at a fruit stand is one of the few jobs they can get.

The Asamblea Nacional approved a motion Tuesday that would eliminate a section of the new customs law that has caused consternation and financial loss for importers.

The section of the law says that an importer must show the customs declaration of the exporting country in order to claim merchandise from customs or aduana officials.

The problem was that the need for the documentation was not publicized, and millions of dollars of sometimes perishable products languished in customs because the importing firm did not have the documentation.

Both Argentina and Brazil have given their support to former president Miguel Angel Rodríguez to be secretary general of the Organization of American States.

That brings to 23 the number of nations who have come out publicly for the former president. Presidents of Argentina and Brazil, Néstor
Kirchner and Luiz Inacio "Lula" Da Silva, made the joint announcement Tuesday in Rio de Janeiro.
